In 2000 the European Court of Justice decided that if someone is declared bankrupt in one member state this must be recognised in other member states as well.

EU law: Bankruptcies in other members states must be recognised

This means that if you are Dutch with debts in Holland and you are declared bankrupt in France, then your Dutch creditors must honour this status and can no longer chase you for their money. Of course this would only work if you lived in France. Otherwise you couldn't be made bankrupt there.

Likewise there are other pitfalls. For example the bankruptcy procedures in both countries must be similar for the rule to apply.

The UK advantage: Get cleared in just 12 months

Now you wonder why on earth it can be interesting to file for bankruptcy in another EU member state? Well, it becomes interesting when the whole process is a lot quicker in one state than another. For example, in Germany it takes seven years until bankrupts are discharged. In contrast: in the UK it takes just 12 months. That's right. You are fully discharged and can make a fresh start after 12 months. All your German debts will have been wiped out.

The most important requirement to be made bankrupt in the UK

To be made bankrupt in the UK you need to have lived here for at least 6 months. Of course you are not allowed to move to the UK just to be made bankrupt. If you did that the court would decide that you don't fall under their jurisdiction.

If you don't live in the UK at the moment you may conisder moving here. Once you live in the UK for at least six months carrying out formal employment, you will be allowed to file for bankruptcy as you will then be considered to be under the jurisdiction of the courts here.
